For job applicants, the relevant company is the company conducting recruitment; for employees, it is the employer named in the employment contract. The common sales process does not make employee or applicant records generally accessible to both companies.
Each company is a data controller for the processing activities whose purposes and means it determines. In these texts, “Company” means the company identified in the documents for your particular transaction and process.
1. Scope
This notice explains processing of personal data obtained during job applications and recruitment at SwissOffices under KVKK.
2. Personal data
Depending on the position and process, we may process your name, date of birth and any photograph you include in your CV; telephone, email, city/district of residence and other supplied contact details; education, diplomas, qualifications, certificates, employment history, roles, languages and IT skills; position applied for, application date and channel, interview/assessment records, salary expectations, working preferences and suitability assessments; names, roles and contact details of references and job-related information from reference checks; IP addresses and electronic access/system logs; and other CV/application information necessary to assess your suitability.
We avoid collecting special-category data in initial recruitment stages. Please do not include health, criminal-conviction or other sensitive information unless needed to assess the application.
3. Purposes and grounds
3.1. Applications
Identity, contact, professional and applicant-transaction data are used to receive applications, review qualifications and experience, conduct interviews, assess suitability, make recruitment decisions and communicate with you. The grounds are Article 5(2)(c), processing directly necessary to establish a contract, and Article 5(2)(f), legitimate interests in identifying suitable candidates and managing HR, without harming fundamental rights and freedoms.
3.2. Interviews and assessments
Interview information and assessment records support objective evaluation of skills and experience and recording recruitment decisions, on the same grounds. Information unrelated to the position is not intended to be processed.
3.3. References
Where you provide references or a reference check is necessary, limited data may be used to verify work history and duties and assess professional suitability under Article 5(2)(f). Checks are limited to necessary and proportionate recruitment information.
3.4. Legal rights
Application, assessment and correspondence records may be retained for a period to address claims/disputes and establish, exercise or protect rights under Article 5(2)(e).
4. Special-category data
As a rule, special-category personal data are not requested at the assessment stage.
5. Recipients
Where necessary for recruitment and under Article 8, data may be shared with HR/recruitment providers if used; IT, email, cloud and recruitment-platform providers to receive, store and manage applications; lawyers where disputes or protection of rights require it; and competent public authorities for statutory duties or duly made requests. Data are not shared with unrelated third parties.
6. Collection
Sources include CVs and applications you send, the website, email, job/recruitment platforms, in-person or online interviews, forms, recruiters, your references and information you provide during recruitment. Processing may be automated, partly automated, or non-automated within a filing system. Third-party job platforms may be independent controllers for their own activities.
7. Retention
If employed
Information needed to manage employment may be transferred to your personnel file and systems and continue to be processed under the Employee Privacy Notice.
If not employed
Application information is retained for one year from the end of the application process to handle possible disputes and protect rights. It is then erased, destroyed or anonymised unless another retention ground exists.
Future vacancies
Keeping your CV and contact information in a candidate pool for different future vacancies is separate from assessing your present application. If SwissOffices relies on explicit consent for that purpose, a separate consent text is provided. Refusing such consent does not disadvantage your current application.
8. Rights and requests
Under Article 11 of Turkish Personal Data Protection Law No. 6698 (“KVKK”), you may learn whether your data are processed; request information about processing; learn its purpose and whether data are used accordingly; learn the recipients in Türkiye or abroad; request correction of incomplete or inaccurate data; request erasure or destruction when the legal conditions are met; request notification of correction, erasure or destruction to recipients; object to an adverse result arising solely from automated analysis; and seek compensation for damage caused by unlawful processing.
You may submit a signed written request to Levent Mah. Cömert Sok. No:1/C D:40 34330 Beşiktaş İstanbul; use a secure electronic signature or mobile signature; email info@swissoffices.com from an email address previously notified to and recorded by the relevant company; or use another method permitted by the applicable legislation.
Your request must include your full name, signature for written requests, Turkish identity number for Turkish citizens or nationality and passport number or other identity number for foreign nationals, address for service, any notification email address, telephone and fax number, the subject of the request and relevant supporting information. Do not provide documents unnecessary to identify you and assess the request.
Requests are answered as soon as possible and within 30 days. They are normally free; a charge under the Board’s tariff may apply where a response requires an additional cost. See Your rights and requests.
